PRIVACY POLICY
1. Introduction
AJIS (9129-4082 Québec inc.) makes great games and apps that offer fun and entertainment experiences for everyone to enjoy. We at AJIS respect the privacy of everyone who uses our games, website(s) and all related services which we may provide to you from time to time (“Services”). In this document we refer to AJIS (9129-4082 Québec inc.) as “AJIS” “us”, “we” or “our” and we refer to you as “you” and “your”.
This document, the "Privacy Policy", explains how we collect, process and store any personal data belonging to you, meaning information about you which is personally identifiable such as your name, address, telephone number or email address. Such information is referred to throughout this policy as "Personal Information" or “data”.
By accessing and/or using our Services you consent to us collecting, processing, storing and sharing your Personal Information in the ways set out in this Privacy Policy. If you have any concerns about providing data to us or having it used in any manner permitted in this Privacy Policy you should not use our Services. As set out in the terms and conditions relating to our Services, you must be at least 13 years old to access and use our Services.

Information that you provide us with when you fill in forms when using our Services, or when you create an account with us; details of your use of our Services and the resources that you access (for example, information about how and when you play our games or visit our website(s), or what device you use to access our Services); if you contact us or respond to messages and communications that we send to you, we may keep a record of that correspondence; your interactions with us on our social media channels; and information we collect via cookies, as explained further below.
Cookies & PHP Servers:
We use cookies, PHP Servers and other similar technologies. Cookies are small files which store some information on your computer or mobile device. PHP Servers store information in an encrypted and protected database.
We use them to allow us to recognise you and your device, for example by identifying your IP address; to allow our Services to interact with a third party social network or platform (where you have chosen to allow such interaction); to allow our payment processors to process your payment instructions; to provide you with more customized Services, for example to provide our Services in the correct language; to obtain data which will allow us to understand how people are using our Services so that we can improve them. By accessing our website(s) or using our Services you consent to our use of cookies in accordance with this Privacy Policy. You can disable cookies through your web or phone browser settings but you may find you are not able to enjoy all the features of our Services if you do so. Most of the saved game data is saved on our secure PHP server. The information gathered is composed of progression information (save game, high scores, etc.) and user info (user id #, purchases, etc.).This information will not be redistributed or used for any other purpose then storing your progress and providing us information in case of technical problems/issues.
Payment Information
When you purchase Services on our website(s), we may collect certain payment information from you on behalf of our payment service providers, but this information is temporarily cached in a way that is unreadable by AJIS. When you purchase items via our apps (such as those you can purchase in the App Store, via Facebook or on Google Play) we do not collect or store any payment information from you.
4. How will we use your Personal Information?You agree that we (or a supplier or group company acting on our behalf and only under our instructions) may use your Personal Information for the purposes of:
Contacting you, for example as part of customer service or to send you updates about our Services; managing your account and relationship with us and improving your experience when you use our Services; research, surveying, and engaging with you, for example by sending you communications (including by email) for these purposes; marketing and promotion of our Services or related products, for example sending you communications (including by email) for these purposes on our, or a third party's behalf. For example, we might send you information about merchandise relating to our Services. If you do not want us to use your data in this way please let us know by contacting us at privacy@ajis.ca; to create reports, analysis or similar services for use by us for the purposes of research or business intelligence, for example to track potential problems or trends with our Services; preventing cheating, crime or fraud. We may also need to pass your information to fraud prevention agencies and other organisations involved in crime and fraud prevention.
5. Will we share your Personal Information with third parties?We will only share your data with third parties (for example, our group companies or suppliers): with your consent (including as set out in this Privacy Policy); as reasonably necessary in order to provide the Services to you (for example, by providing your Personal Information to suppliers we may use to fulfil the Services or to communicate with you); where it is necessary to carry out your instructions (for example, to process a payment instruction we must provide your Personal Information to our payment processors); where your data is on an anonymous and aggregated basis, meaning you could not be personally identified from it; when you submit information as part of a competition or otherwise interact with our social media channels (for example, by providing a testimonial about one of our Services) we may publish the information you submitted, alongside your name and home country on our website and social media channels; as we reasonably believe is permitted by law or regulation; in order to comply with any legal obligation, or in order to enforce or apply our terms and conditions and/or any other agreement with you; or to protect the rights, property, or safety of AJIS, our users, or others; in the event that there is a sale of the assets of AJIS or corporate restructuring, or as a result of a change of control of AJIS or one of its group companies, or in preparation of any of these events. Any third party to which AJIS transfers of sells AJIS’s assets will have the right to continue to use the personal and other information that you provide to us in the manner set out in this Privacy Policy. We will not sell or rent your information to any third party outside of these circumstances.
6. Interaction with third party social networks or platformsYou may allow our Services to interact with a third party social network or platform, which will provide data about you to us. These applications or websites are created and maintained by a third party who is not a part of, or controlled by AJIS. You should ensure that you read their terms of service and privacy policies to understand how they treat your data and what data they might share with us. You understand that where you allow your account with us to interact with any third party social network or platform, we may share data about you with your contacts (and vice versa) in order that you may enjoy playing socially. This data includes your name, your social media profile picture and your scores and/or progress in our games. You can make changes to what data a third party social network or platform shares with us, or stop our Services interacting with that social network or platform by adjusting your settings with that third party provider, however you may find you are not able to enjoy all of the same features of our Services.
7. For how long will we retain your information?We will retain your Personal Information for as long as is necessary to fulfil the purposes for which it was collected or as needed to provide you with Services. We may retain your Personal Information after you have closed any account you have with us or after we have ceased providing Services to you if retention of your Personal Information is reasonably necessary to comply with our legal obligations, meet regulatory requirements, resolve disputes between members, prevent fraud, cheating or abuse, or enforce this Privacy Policy or any other agreement we may have with a user.
8. How do we protect your Personal Information?The security of your Personal Information is important to us. We maintain appropriate technical and physical safeguards to protect your Personal Information against accidental or unlawful destruction or loss, alteration, unauthorised disclosure or access, use and all other unlawful forms of processing of the data in our possession. We use the same level of skill in protecting your Personal Information as other similar games developers. However, since the internet is not a completely secure environment we cannot guarantee that information you transmit via our Games will not be accessed, disclosed, altered or destroyed by breach of any of our safeguards.
9. Links from our ServicesWe may provide links to third party websites from our Services. You understand that when you click on these links any data which you provide thereafter is subject to such third party’s privacy policy and not to ours. Although we will endeavour only to link to reputable websites; AJIS takes no responsibility for the content, safety or security of any third party website.

11. ComplaintsWe hope that you won’t have any complaints about us or our Services. 12. Legal mattersIf any court or other competent authority finds any of the terms of this Privacy Policy to be invalid or unenforceable, the other terms of this Privacy Policy will not be affected. This Privacy Policy is governed by and interpreted in accordance with the laws of Canada & Québec. Any dispute arising in connection with this Privacy Policy will be subject to the exclusive jurisdiction of the courts of Québec unless you choose the courts of your home country. We may amend this Privacy Policy from time to time to reflect improvements or any other changes to our business. If you object to any of the changes you should immediately stop using our Services and close any account you may have with us. This Privacy Policy was last updated on March 1st 2017.
TERMS OF SERVICE AND END USER LICENSE AGREEMENT
Applicable from: March 1st 2014.
The following terms of service and end user license agreement (“EULA”) constitute an agreement between you and AJIS 9129-4082 Québec Inc., and its affiliates (“AJIS”). This EULA governs your use of Software and Services (as specified below).
For purposes of this EULA "Software" means all software programs distributed, published or otherwise made available by AJIS or its affiliates including, but not limited to mobile games/apps, downloadable/installable games/apps for personal computer, and games/apps accessed by means of a browser or other online communication method. Software also includes updates and upgrades as well as accompanying manual(s), packaging and other written, files, electronic or on-line materials or documentation, and any and all copies of such software and its materials.
“Services” means all services made available by AJIS, including but not limited to services accessed through mobile games, by means of a browser or by other online communication method.
Software and Services are collectively referred to as “AJIS Services”.
THE SOFTWARE IS LICENSED, NOT SOLD. YOUR USE OF THE SOFTWARE (AS SPECIFIED BELOW) IS SUBJECT TO THE TERMS AND CONDITIONS SET FORTH IN THIS EULA. BY INSTALLING, USING OR ACCESSING THE AJIS SERVICES OR ANY MATERIALS INCLUDED IN OR WITH THE AJIS SERVICES, YOU HEREBY ACCEPT THE TERMS OF THIS EULA.
If you do not accept the terms of this EULA, do not install, use or access the AJIS Services.
1 LICENSES
SOFTWARE LICENSE. Subject to this EULA and its terms and conditions, AJIS hereby grants you a non-exclusive, non-transferable, non-sub licensable, limited right and license to use one copy of the Software for your personal non-commercial use for gameplay on a single computer or gaming unit, unless otherwise specified in the Software documentation. The rights granted herein are subject to your compliance with this EULA. The Software is being licensed to you and you hereby acknowledge that no title or ownership in the Software is being transferred or assigned and this EULA is not to be construed as a sale of any rights in the Software.
SERVICE LICENSE. Subject to this EULA and its terms and conditions, AJIS hereby grants you a non-exclusive, non-transferable, non-sub licensable, limited right and license to use the Services as provided by AJIS, for your personal non-commercial use, in the manner permitted by this EULA. The rights granted herein are subject to your compliance with this EULA.
LICENSE TERM. The term of your licenses under this EULA shall commence on the date that you accept this EULA and install or otherwise use the Software and/or Services and ends on the earlier date of either your disposal of the Software and/or Services or AJIS's termination of this EULA. Your license terminates immediately if you attempt to circumvent any technical protection measures used in connection with the Software and/or Services or you otherwise use the Software and/or Services in breach of the terms of this EULA.
OWNERSHIP; NO OTHER LICENSES. AJIS retains all right, title and interest in and to the AJIS Services, including, but not limited to, all copyrights, trademarks, trade secrets, trade names, proprietary rights, patents, titles, computer codes, audiovisual effects, themes, characters, character names, stories, dialog, settings, artwork, sound effects, musical works, and moral rights whether registered or not and all applications thereof. The AJIS Services are protected by applicable laws and treaties throughout the world. Unless expressly authorized by mandatory legislation, the AJIS Services may not be copied, reproduced or distributed in any manner or medium, in whole or in part, without prior written consent from AJIS. All rights not expressly granted to you herein are reserved by AJIS.
2 THIRD PARTY SERVICES
AJIS Services may include links to third party services and/or the third party services may be made available to you via AJIS Services. These services may include, but are not limited to gameplay recording and sharing, social medial connectivity and the like. These services are subject to respective third party terms and conditions. Please study these third party terms and conditions carefully as they constitute an agreement between you and the applicable third party service provider.
3 GENERAL LICENSE CONDITIONS
You agree not to: (i) commercially exploit the AJIS Services; (ii) distribute, lease, license, sell, rent, lend, convey or otherwise transfer or assign the AJIS Services, any copies thereof, or any passwords or usernames of AJIS Services, without the express prior written consent of AJIS or as set forth in this EULA; (iii) make a copy of the AJIS Services or any part thereof, including but not limited to Software (other than as set forth herein); (iv) make the AJIS Services publicly available or available on a network for use or download by multiple users; (v) except as otherwise specifically provided by the AJIS Services or this EULA, use or install the AJIS Services (or permit others to do same) on a network, for on-line use, or on more than one computer or gaming unit at the same time; (vi) use or copy the AJIS Services at a computer gaming center or any other location-based site; provided, that AJIS may offer you a separate site license agreement to make the AJIS Services available for commercial use; (vii) reverse engineer, decompile, disassemble, translate, prepare derivative works based on or otherwise modify the AJIS Services, in whole or in part; (viii) remove, obscure or modify any copyright, trademark or other proprietary rights notices, marks or labels contained on or within the AJIS Services, falsify or delete any author attributions, legal notices or other labels of the origin or source of the material; (ix) misrepresent the source of ownership of the AJIS Services; (x) transport, export or re-export (directly or indirectly) into any country forbidden to receive such AJIS Services by any U.S. or other export laws or accompanying regulations or otherwise violate such laws or regulations, that may be amended from time to time; or (xi) scrape, build databases or otherwise create permanent copies of content returned from the AJIS Services.
However, with regards to installable Software that was delivered on a physical storage medium, you may transfer the entire Software and accompanying documentation on a permanent basis to another person as long as you retain no copies (including archival or backup copies) of the Software, accompanying documentation, or any portion or component of the Software accompanying documentation, and the recipient agrees to the terms of this EULA The Software is intended for private use only.
The AJIS Services may include measures to control access to the AJIS Service, prevent unauthorized copies, or otherwise attempt to prevent anyone from exceeding the limited rights and licenses granted under this EULA. Only AJIS Services subject to a valid license can be used to access online services, and download updates and patches. You may not interfere with such access control measures or attempt to disable or circumvent such security features. If you disable or otherwise tamper with the technical protection measures, the AJIS Services will not function properly.
The AJIS Services may allow you to create content, including but not limited to gameplay maps, screenshots or a video of your game play. In exchange for use of the AJIS Services, and to the extent that your contributions through use of the AJIS Services give rise to any copyright, design right or any other intellectual or industrial property right you hereby grant AJIS an exclusive, royalty-free, perpetual, irrevocable, fully transferable and sub-licensable worldwide right and license to use your contributions in any way and for any purpose including, but not limited to the rights to reproduce, copy, adapt, modify, perform, display, publish, broadcast, transmit, or otherwise communicate to the public by any means whether now known or unknown and distribute your contributions without any further notice or compensation to you of any kind for the whole duration of protection granted to intellectual and industrial property rights by applicable laws and international conventions. If not expressly prohibited by mandatory legislation, you hereby waive any moral rights of paternity, publication, reputation, or attribution with respect to AJIS's and other players' use and enjoyment of such assets in connection with the AJIS Services and related goods and services under applicable law. This license grant to AJIS, and the above waiver of any applicable moral rights, survives any termination of this EULA.
The AJIS Services may require an internet connection to access the AJIS Services or its internet-based features, authenticate the Software, or perform other functions. In order for certain features of the AJIS Services to operate properly, you may be required to have and maintain (a) an adequate internet connection and/or (b) a valid and active account with an online service as set forth in the documentation related to AJIS Services. By using the AJIS Services, you acknowledge and agree that third party data transfer fees may apply depending on your data plan. Please consult your carrier for further information. If you do not maintain such accounts, then the AJIS Services or certain features of the AJIS Services may not operate or may cease to function properly, either in whole or in part.
4 INFORMATION COLLECTION AND USE; PRIVACY POLICY
By installing, accessing or using the AJIS Services, you consent to these information collection and usage terms, including (where applicable) the transfer of data into a country outside of the European Union and/or the European Economic Area or the United States of America or Canada.
AJIS respects your privacy rights and recognizes the importance of protecting any information collected about you. AJIS's privacy policy as amended from time to time is available at www.AJIS.com/legal/PrivacyPolicy ("Privacy Policy") and applicable to this EULA. AJIS’s Privacy Policy defines how, why and to which extent AJIS collects and uses personal and non-personal information in relation to AJIS's products and services. By installing, accessing or using the AJIS Services you explicitly agree with the terms and conditions of AJIS’s Privacy Policy and to any terms and conditions included therein by reference.
5 PAYMENTS AND PURCHASES OF VIRTUAL GOODS
AJIS may license to you certain virtual goods to be used within AJIS Services. Unless otherwise specified, these virtual goods shall be deemed an integral part of the Software. These virtual goods may be licensed both for a fee using “real world money” and without any separate fee, as applicable from time to time. These virtual goods may also be licensed by using third party virtual currency, such as Facebook Credits or by using separate activation codes.
Any and all virtual goods are licensed to you on limited, personal, non-transferable, non-sublicensable and revocable basis and limited only for non-commercial use.
Please note that any payment for licenses for virtual goods or redemption of third party virtual currency is always FINAL AND NON-REFUNDABLE. Also please note that if you purchase Facebook Credits from Facebook, such transaction is governed by the agreement between you and Facebook and AJIS is not a party to the transaction.
AJIS may manage, regulate, control, modify or eliminate virtual goods at any time, with or without notice. AJIS shall have no liability to you or any third party in the event that AJIS exercises any such rights.
SUBJECT TO MANDATORY LEGISLATION, YOU ACKNOWLEDGE THAT AJIS IS NOT REQUIRED TO PROVIDE A REFUND FOR VIRTUAL GOODS FOR ANY REASON, AND THAT YOU WILL NOT RECEIVE MONEY OR OTHER COMPENSATION FOR UNUSED VIRTUAL GOODS, WHETHER YOUR LOSS OF LICENSE UNDER THIS EULA WAS VOLUNTARY OR INVOLUNTARY.
6 WARRANTY
6.1 Warranty for Physical software Products
AJIS warrants to you (if you are the initial and original purchaser of the Software) that, to the extent the Software is made available to you on a physical storage medium, the original storage medium holding the Software is free from defects in material and workmanship under normal use and service for 90 days from the date of purchase. If mandatory legislation in your jurisdiction requires longer in excess to the aforementioned 90 days, the length of the warranty is amended accordingly. If for any reason you find a defect in the physical storage medium during the warranty period, AJIS agrees to replace, free of charge, any physical storage medium and related Software discovered to be defective within the warranty period as long as the Software is currently commercially distributed by AJIS. If the Software is no longer available, AJIS retains the right to substitute a similar piece of Software of equal or greater value. This warranty is limited to the physical storage medium and the Software as originally provided by AJIS and is not applicable to normal wear and tear. This warranty shall not be applicable and shall be void if the defect has arisen through abuse, mistreatment, or neglect. Any implied warranties prescribed by statute are expressly limited to the warranty period described above.
When returning the Software subject to the limited warranty above, please send the original Software only to the AJIS address specified below and include: your name and return address; a photocopy of your dated sales receipt; and a brief note describing the defect and the system on which you are running the Software.
6.2 No other Warranties
NOTWITHSTANDING THE ABOVEMENTIONED WARRANTY FOR PHYSICAL STORAGE MEDIUM SPECIFIED IN SECTION 6.1 ABOVE, AND TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, THE AJIS SERVICES ARE PROVIDED TO YOU “AS IS,” WITH ALL FAULTS, WITHOUT WARRANTY OF ANY KIND, WITHOUT PERFORMANCE ASSURANCES OR GUARANTEES OF ANY KIND, AND YOUR USE IS AT YOUR SOLE RISK. THE ENTIRE RISK OF SATISFACTORY QUALITY AND PERFORMANCE RESIDES WITH YOU. AJIS, AJIS’S LICENSORS AND CHANNEL PARTNERS DO NOT MAKE, AND HEREBY DISCLAIM, ANY AND ALL EXPRESS, IMPLIED OR STATUTORY WARRANTIES, INCLUDING IMPLIED WARRANTIES OF CONDITION, UNINTERRUPTED USE, ACCURACY OF DATA (INCLUDING BUT NOT LIMITED TO LOCATION DATA), MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, NONINFRINGEMENT OF THIRD PARTY RIGHTS, AND WARRANTIES (IF ANY) ARISING FROM A COURSE OF DEALING, USAGE, OR TRADE PRACTICE. AJIS, AJIS’S LICENSORS AND CHANNEL PARTNERS DO NOT WARRANT AGAINST INTERFERENCE WITH YOUR ENJOYMENT OF THE SOFTWARE; THAT THE AJIS SERVICES WILL MEET YOUR REQUIREMENTS; THAT OPERATION OF THE AJIS SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT THE AJIS SERVICES WILL INTEROPERATE OR BE COMPATIBLE WITH ANY OTHER AJIS SERVICES OR THAT ANY ERRORS IN THE AJIS SERVICES WILL BE CORRECTED. NO ORAL OR WRITTEN ADVICE PROVIDED BY AJIS, AJIS’S LICENSORS AND CHANNEL PARTNERS OR ANY AUTHORIZED REPRESENTATIVE SHALL CREATE A WARRANTY. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF OR LIMITATIONS ON IMPLIED WARRANTIES OR THE LIMITATIONS ON THE APPLICABLE STATUTORY RIGHTS OF A CONSUMER, SO SOME OR ALL OF THE ABOVE EXCLUSIONS AND LIMITATIONS APPLY ONLY TO THE FULLEST EXTENT PERMITTED BY LAW IN THE APPLICABLE JURISDICTION.
7 LIMITATION OF LIABILITY
IN NO EVENT WILL AJIS, AJIS’S AFFILIATES, AJIS’S LICENSORS OR CHANNEL PARTNERS BE LIABLE FOR SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES RESULTING FROM POSSESSION, ACCESS, USE OR MALFUNCTION OF THE AJIS SERVICES, INCLUDING BUT NOT LIMITED TO, DAMAGES TO PROPERTY, LOSS OF GOODWILL, COMPUTER FAILURE OR MALFUNCTION AND, TO THE EXTENT PERMITTED BY LAW, DAMAGES FOR PERSONAL INJURIES, PROPERTY DAMAGE, LOST PROFITS OR PUNITIVE DAMAGES FROM ANY CAUSES OF ACTION ARISING OUT OF OR RELATED TO THIS EULA OR THE SOFTWARE, WHETHER ARISING IN TORT (INCLUDING NEGLIGENCE), CONTRACT, STRICT LIABILITY OR OTHERWISE AND WHETHER OR NOT AJIS, AJIS’S LICENSORS OR CHANNEL PARTNERS HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. FOR PURPOSES OF THIS SECTION 7, AJIS’S LICENSORS AND CHANNEL PARTNERS ARE THIRD PARTY BENEFICIARIES TO THE LIMITATIONS OF LIABILITY SPECIFIED HEREIN AND THEY MAY ENFORCE THIS EULA AGAINST YOU.
BECAUSE SOME STATES/COUNTRIES DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY, THIS LIMITATION OF LIABILITY SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW IN THE APPLICABLE JURISDICTION. THIS LIMITATION OF LIABILITY SHALL NOT BE APPLICABLE SOLELY TO THE EXTENT THAT ANY SPECIFIC PROVISION OF THIS LIMITATION OF LIABILITY IS PROHIBITED BY ANY FEDERAL, STATE, OR MUNICIPAL LAW, WHICH CANNOT BE PRE-EMPTED. THIS EULA GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY HAVE OTHER RIGHTS THAT VARY FROM JURISDICTION TO JURISDICTION.
IN NO EVENT SHALL AJIS’S, AJIS’S AFFILIATES’, AJIS’S LICENSORS’ OR CHANNEL PARTNERS’ LIABILITY FOR ALL DAMAGES (EXCEPT AS REQUIRED BY APPLICABLE LAW) EXCEED THE ACTUAL PRICE PAID BY YOU FOR USE OF THE AJIS SERVICES OR TEN CANADIAN DOLLARS (10 CAN), WHICHEVER LESS.
8 OBJECTIONABLE CONTENT AND ABUSIVE USERS
The user understand and agree that the use of our app is subject to the following terms and conditions:
You will not upload, post, transmit, or share any content that is offensive, harmful, defamatory, abusive, discriminatory, or otherwise objectionable. This includes, but is not limited to, content that contains explicit language, explicit images, hate speech, harassment, violence, or any other form of inappropriate or harmful content.
Filtering Mechanism: Our app includes a content filtering mechanism that automatically scans and detects objectionable content. However, please note that this mechanism may not be perfect and some objectionable content may still be present on the app.
Flagging and Blocking: If you come across any objectionable content or encounter abusive behavior from other users, you agree to use the reporting and blocking features provided by the app. This includes flagging objectionable content and blocking abusive users using the functionalities available in the app's user interface.
Action on Objectionable Content Reports: We take objectionable content reports seriously and strive to address them promptly. We will make reasonable efforts to review and take appropriate action, such as removing objectionable content and ejecting users who provide offending content, within 24 hours of receiving the report, as long as it falls within the scope of our policies and guidelines.
User Guidelines: By using our app, you acknowledge and agree to abide by our guidelines and policies regarding objectionable content and abusive behavior. We reserve the right to suspend, terminate, or restrict your access to the app, in our sole discretion, if you violate these guidelines.
We are committed to providing a safe and enjoyable experience for all users of our app. If you encounter objectionable content or abusive behavior, please report it to us immediately using the flagging mechanism provided in the app. Thank you for helping us maintain a positive environment for our community.
9 OTHER TERMS AND CONDITIONS
TERMINATION: This EULA will terminate automatically if you fail to comply with its terms and conditions. In such event, you must destroy all copies of the Software and all of its component parts and cease and desist from accessing any AJIS Services. With regards to Software delivered on a physical storage medium you can end this EULA by destroying the Software and all copies and reproductions of the Software and deleting and permanently purging the Software from any client server or computer on which it has been installed.
EQUITABLE REMEDIES: You hereby agree that if the terms of this EULA are not specifically observed, AJIS will be irreparably damaged, and therefore you agree that AJIS shall be entitled, without bond, other security or proof of damages, to appropriate equitable remedies with respect to your breach of any of the terms of this EULA, in addition to any other available remedies.
AFFILIATE: For purposes of this EULA, an “affiliate” or AJIS means any legal entity that is directly or indirectly controlled by AJIS for so long as such control lasts. Control shall exist through direct or indirect ownership of more than 50 % of the nominal value of the issued equity share capital or more than 50 % of the shares entitling the holders to vote for the election of the members of the board of directors or persons performing similar functions.
INDEMNITY: You agree to indemnify, defend and hold AJIS, its partners, affiliates, contractors, officers, directors, employees and agents harmless from and against any and all damages, losses and expenses arising directly or indirectly from: (i) your acts and omissions to act in using the AJIS Services pursuant to the terms of the EULA; or (ii) your breach of this EULA.
NAME RESERVATION: Some apps, products or services may allow for name reservation. AJIS doesn't guarantee that they will withhold, make available or reserve these names indefinitely or for any period. AJIS reserves the right to revoke that name, which might include recalling or doing anything that would make any name inaccessible, unusable, deleted, or unavailable on any platform. If the user has paid an amount of money to reserve a name for a period and that name is revoked or rendered unavailable for the remainder of the duration of the reserved time, AJIS will not re-imburse the amount paid for the name reservation nor assume any responsibility. The revocation may be justified by many reasons and AJIS reserve the right to do so without justification. This being said, AJIS doesn't intend to do so unless names have been reported, are offensive or are using a generic type that is not proper to a single organisation or individual but could be use by the general community (no appropriation of general types).
MISCELLANEOUS: This EULA represents the complete agreement concerning this license between the parties and supersedes all prior agreements and representations between them. AJIS reserves the right, at its discretion, to change, modify, add or remove portions of this EULA by posting the updated EULA on AJIS’s website. You will be deemed to have accepted such changes by continuing to use the AJIS Services. If any provision of this EULA is held to be unenforceable for any reason, such provision shall be reformed only to the extent necessary to make it enforceable and the remaining provisions of this EULA shall not be affected.
GOVERNING LAW AND DISPUTE RESOLUTION. This EULA will be governed by the laws of Québec/Canada without reference to its choice of law rules. The United Nations Convention for the International Sale of Goods shall not apply.
Any dispute, controversy or claim arising out of or relating to this EULA or the breach, termination or validity thereof shall be finally settled at AJIS's discretion (i) at your domicile's competent courts; or (ii) by arbitration in accordance with the Canadian Corperate Law. The arbitration shall be conducted in St-Jérôme, Québec, Canada in the English or French language. YOU AGREE THAT YOU MAY BRING CLAIMS AGAINST AJIS ONLY IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE
